Terms and Conditions
1. Engagement of Photographer
The Client hires Full Flavour Studio ("Photographer") to provide food and commercial photography services as agreed. The Photographer will capture and deliver professionally edited images ("Work Product") based on the agreed scope of work.
The Photographer will be the sole provider of photography services for the project unless the Client informs otherwise in advance.
2. Fees and Payment
Quotation & Invoice: The total service fee will be detailed in an invoice provided upon booking.
Booking Fee (Deposit): A non-refundable deposit (typically 25-50% depending on the project scale) is required to secure and confirm the booking date. The booking date will not be held or confirmed until the deposit has been received.
Confirmation: Any enquiry or verbal confirmation without deposit payment does not constitute a confirmed booking.
Balance Payment: Full payment of the remaining balance must be made on or before the day of the photoshoot.
Expenses: Costs for specific ingredients, props, background materials, or rental equipment purchased specifically for the shoot at the Client's request will be billed to the Client.
Overtime: Any extra hours beyond the agreed time will be billed separately and must be paid before receiving the final images.
Late Payment: Late payments may incur an additional fee.
3. Client Responsibilities (Food & Product Prep)
Product Readiness: The Client is responsible for ensuring all food dishes, products, and ingredients are ready and available for the shoot.
Styling Assistance: Unless a professional food stylist is hired, the Client agrees to assist with food preparation to ensure dishes look their best (e.g., plating, freshness).
Location: If shooting on-location (e.g., at the Client's restaurant), the Client must ensure the workspace is clean and has adequate space for lighting equipment.
Food Safety: The Photographer is not responsible for food safety regulations regarding the food handled or photographed. Food used in the shoot is considered "props" and may not be suitable for consumption afterwards.
4. Photographer Responsibilities
The Photographer will perform services professionally, using high-quality equipment and utilizing professional lighting and styling techniques to enhance the food/product appeal.
While the Photographer will consider the Client’s preferences (e.g., mood board, style reference), the final artistic direction, lighting setup, and editing style remain at the Photographer’s discretion.
5. Cancellation and Rescheduling
Cancellation: The booking fee (deposit) is strictly non-refundable if the Client cancels the session.
Rescheduling: The Client may request to reschedule the session with at least 7 days’ notice. In such cases, the deposit will be transferred to the new date.
Photographer Unavailability: In the unlikely event that the Photographer is unable to perform the service due to unforeseen circumstances (e.g., illness, equipment failure), we will make every effort to reschedule the session to a mutually agreed date. If a new date cannot be agreed upon, the contract will be canceled, and a full refund of all monies paid will be issued.
6. Copyright and Licensing (Commercial Use)
Copyright Ownership: All images remain the intellectual property (Copyright) of Full Flavour Studio.
Commercial License: Upon full payment, the Client is granted a Perpetual Commercial License to use the images for business promotion. This includes:
- Website and Social Media (Instagram, Facebook, TikTok).
- Printed Menus, Flyers, and In-store signage.
- Third-party delivery platforms (UberEats, DoorDash, Menulog).
Restrictions: The Client may NOT resell the images to third parties (e.g., stock photo sites) or allow other businesses to use the images without written permission from Full Flavour Studio.
7. Image Usage & Confidentiality
7.1 Standard Promotional Usage: Unless otherwise requested in writing, Full Flavour Studio retains the right to use the images from the session for our portfolio, website, social media, and general marketing purposes.
7.2 Trade Secrets / Unreleased Products: If the subject matter involves unreleased products or secret recipes that require confidentiality until a specific launch date (Embargo), the Client must notify the Photographer in advance.
7.3 NDA Requirements: If the Client requires a formal Non-Disclosure Agreement (NDA), this must be provided before the session.
7.4 Non-Publication Fee: If the Client requests that Full Flavour Studio never use the images for its own portfolio (Buyout), a Non-Publication/Buyout Fee may apply to compensate for the marketing value.
8. Liability and Indemnity
The Client agrees to indemnify the Photographer against any claims related to the services. The Photographer's liability is limited to the total amount paid for the services. Full Flavour Studio is not responsible for any loss of profit or damage to the Client's business reputation alleged to be caused by the images.
9. Responsibility for Equipment and Property
If any damage is caused to the Photographer’s equipment during the session by the Client or their staff, the Client will be responsible for the cost of repair or replacement.
10. Delivery of Work
Timeline: Edited images will be delivered within 7-14 days via an online gallery.
Gallery Expiry: The online gallery will remain active for at least 45 days. Re-uploading after expiry may incur a service fee.
File Format: Only final edited images (High-Resolution JPEG) will be delivered. Unedited RAW files are not included in the service.
11. General Terms
Any modifications to this agreement must be made in writing. This agreement is governed by the laws of Queensland, Australia.
11.1 Updates: Full Flavour Studio may update these Terms and Conditions from time to time. The version in effect at the time of the Client’s booking will apply.
12. Acceptance of Terms
By paying the booking deposit, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions. No additional signature is required.
